การใช้งาน SAPH ถือว่าคุณยอมรับเงื่อนไขนี้ หากไม่ยอมรับ กรุณายุติการใช้งาน ส่วนการจัดการข้อมูลของคุณอธิบายไว้ใน นโยบายความเป็นส่วนตัว ซึ่งถือเป็นส่วนหนึ่งของเงื่อนไขนี้

2. SAPH คืออะไร และไม่ใช่อะไร

SAPH เป็นเครื่องมือบันทึกข้อมูลพอร์ตที่คุณถืออยู่แล้ว ไม่ใช่ โบรกเกอร์ ธนาคาร ที่ปรึกษาการลงทุน หรือผู้ให้บริการชำระเงิน และไม่สามารถซื้อ ขาย หรือโยกย้ายสิ่งใดได้

3. บัญชีของคุณ

SAPH สำหรับผู้ใช้อายุ 18 ปีขึ้นไป การใช้งานบนเว็บต้องเข้าสู่ระบบด้วย Google ส่วนแอปบน Android ใช้ได้โดยไม่ต้องมีบัญชี และจะเข้าสู่ระบบด้วยบัญชีเดียวกันเมื่อไรก็ได้ ซึ่งเป็นทางเลือก ไม่ใช่เงื่อนไขของการใช้งาน

ไม่มีการซื้อหรือสมัครสมาชิกภายในแอปเลย เปิดใช้ได้ทันทีโดยไม่ต้องสมัครอะไร และถ้าไม่เข้าสู่ระบบ ก็ไม่มีช่วงทดลองใช้ที่จะหมดอายุ เพราะไม่มีอะไรให้หมด — ใช้ฟรีแบบนี้ได้ตลอดไป

ข้อมูลที่คุณบันทึกไว้ก่อนเข้าสู่ระบบไม่หายไปไหน เมื่อเข้าสู่ระบบครั้งแรก พอร์ตที่อยู่ในเครื่องกับพอร์ตที่อยู่ในบัญชีจะถูกรวมเข้าด้วยกัน ไม่มีฝั่งไหนถูกทับ

5. นโยบายการคืนเงิน

การซื้อผ่านเว็บ (Stripe)

เงินที่ชำระแล้วไม่สามารถขอคืนได้ ช่วงทดลองใช้ฟรี 14 วันคือโอกาสในการประเมิน SAPH ในช่วงนั้นไม่มีสิ่งใดถูกกันไว้ สิ่งที่คุณกำลังจะซื้อคือสิ่งที่คุณได้ใช้มาแล้ว และสิทธิใช้งานจะอยู่ครบตลอดปีที่คุณชำระไว้

หาก SAPH ขัดข้องจนคุณใช้สิ่งที่จ่ายเงินไปไม่ได้ กรุณาเขียนมาที่ saphdevelop@gmail.com จากอีเมลของบัญชี พร้อมอธิบายว่าเกิดอะไรขึ้น เราพิจารณากรณีเช่นนี้เป็นรายกรณีไป

หากเราตกลงคืนเงินให้

• คืนเต็มจำนวน สิทธิแบบจ่ายเงินสิ้นสุดตั้งแต่วันที่ยื่นขอคืนเงิน ไม่ใช่วันที่เงินเข้าบัญชี การคืนเงินพร้อมเพย์อาจใช้เวลา 3–5 วันทำการกว่าเงินจะถึงธนาคารคุณ แต่บัญชีจะกลับสู่แบบฟรีทันที
• คืนบางส่วน — กรณีที่เราคืนให้เพียงบางส่วน ไม่ใช่ทั้งหมด เพื่อชดเชยเรื่องใดเรื่องหนึ่ง — ไม่ถือเป็นการยกเลิก สิทธิใช้งานของคุณจึงยังอยู่ครบจนหมดปีตามปกติ คุณจะไม่เสียสิทธิทั้งปีไปเพราะการชดเชยเพียงบางส่วน
• ทั้งสองกรณี ข้อมูลของคุณไม่ถูกแตะต้อง การคืนเงินไม่ลบอะไรทั้งสิ้น

แอปบน Android

6. ทรัพย์สินทางปัญญา และการใช้งานอย่างเป็นธรรม

SAPH — โค้ด การออกแบบ เนื้อหา และโลจิกทั้งหมดในแอป เป็นลิขสิทธิ์ของเรา การใช้แอปตามปกติไม่ทำให้คุณได้สิทธิ์เหล่านี้ไปด้วย

กรุณาอย่า: คัดลอกโค้ดหรือการออกแบบไปสร้างบริการของตัวเอง ทำวิศวกรรมย้อนกลับ (reverse engineer) เพื่อจุดประสงค์นั้น นำ SAPH หรือข้อมูลตลาดในนั้นไปขายต่อหรือเผยแพร่ เป็นบริการของตนเอง พยายามเข้าถึงข้อมูลของผู้ใช้รายอื่น ส่งคำขออัตโนมัติในปริมาณที่กระทบ ผู้ใช้คนอื่น หรือหลบเลี่ยงฟีเจอร์แบบจ่ายเงินแทนการจ่ายเงิน

7. ความพร้อมใช้งาน การเปลี่ยนแปลง และการยุติบริการ

SAPH ให้บริการตามความพยายามอย่างดีที่สุด (best-effort) ไม่มีการรับประกันเวลาให้บริการ อาจใช้งานไม่ได้เพราะการปรับปรุงระบบ เพราะบริการภายนอกที่เราพึ่งพาล่ม หรือโดยไม่ได้แจ้งล่วงหน้า

ฟีเจอร์อาจเปลี่ยนแปลงได้ตามการพัฒนาแอป หากการเปลี่ยนแปลงใดทำให้สิ่งที่บัญชีแบบจ่ายเงินใช้อยู่หายไป เราจะแจ้งให้ทราบล่วงหน้า ไม่ปล่อยให้หายไปโดยไม่บอกกล่าว

เราอาจยุติการให้บริการได้ หากถึงวันนั้น เราจะแจ้งทางอีเมลก่อน และการส่งออกข้อมูลจะยังใช้งานได้ เพื่อให้คุณนำข้อมูลของคุณออกไปได้

8. ขอบเขตความรับผิด

SAPH ให้บริการตามสภาพที่เป็นอยู่ ("as is") เท่าที่กฎหมายไทยอนุญาต เราไม่รับผิดต่อผลขาดทุนจากการลงทุน ผลทางภาษี การตัดสินใจที่อาศัยตัวเลขในแอป หรือข้อมูลที่สูญหายในกรณีที่คุณไม่ได้สำรองไว้ ทั้งนี้ไม่มีข้อความใดในหน้านี้ที่จำกัดความรับผิดที่กฎหมายไม่อนุญาตให้จำกัด และไม่มีข้อความใดกระทบสิทธิของคุณในฐานะผู้บริโภคตามกฎหมายไทย

ในกรณีที่เราต้องรับผิด ความรับผิดรวมของเราจำกัดไม่เกินจำนวนเงินที่คุณชำระให้เรา ในระยะเวลาสิบสองเดือนก่อนการเรียกร้องนั้น

9. การเปลี่ยนแปลงเงื่อนไข

หากเงื่อนไขนี้มีการเปลี่ยนแปลง เราจะเผยแพร่ฉบับปรับปรุงบนหน้านี้พร้อมระบุวันที่ใหม่ การเปลี่ยนแปลงที่กระทบบัญชีแบบจ่ายเงินอย่างมีนัยสำคัญ จะแจ้งทางอีเมลก่อนมีผลบังคับใช้ด้วย

10. กฎหมายที่ใช้บังคับ

เงื่อนไขนี้อยู่ภายใต้บังคับแห่งกฎหมายไทย และให้ศาลไทยเป็นผู้มีอำนาจพิจารณา ในกรณีที่ข้อความภาษาไทยและภาษาอังกฤษบนหน้านี้แตกต่างกัน ให้ใช้ข้อความภาษาไทย

1. Who we are, and what this covers

SAPH is developed and operated by an independent developer in Thailand, contactable at saphdevelop@gmail.com. These terms cover the SAPH website at saph-set.pages.dev and the SAPH Android applications.

By using SAPH you accept these terms. If you do not accept them, please discontinue use. How we handle your data is described separately in the Privacy Policy, which forms part of these terms.

2. What SAPH is — and what it is not

SAPH is a record-keeping tool for a portfolio you already hold. It is not a broker, a bank, an adviser, or a payment service. It cannot buy, sell, or move anything.

Nothing in SAPH is investment advice. Figures shown — prices, NAV, profit and loss, returns, tax-year summaries — are calculations over what you entered, using market data from public sources. They may be delayed, incomplete, or wrong. Check with your broker, your asset management company, and your own tax adviser before making any decision or filing anything. Your investment decisions are yours alone.

Market data

Prices and NAV come from public sources including Yahoo Finance and the Thai SEC open-data service. That data is provided by those sources "as is". We do not own it, cannot guarantee it, and it may stop being available to us at any time — in which case the affected figures stop updating.

3. Your account

SAPH is for users aged 18 or over. The website requires signing in with Google. The Android app works without an account, and you may sign into it with the same account at any time — that is a choice, not a condition of using it.

An account is for one person. You are responsible for what is entered under it and for keeping access to your Google account secure. You may delete your account at any time from Settings, which deletes your data with it.

Keep your own backups. Export to Excel is available on every plan, including the free one. We take reasonable care, but we are one developer with a hosted database, not a bank: do not let SAPH be the only copy of records you cannot afford to lose.

4. Free trial, prices, and what free keeps

Payment is processed by Stripe and made on Stripe's own pages; we never see or store any of it.

When a year ends, or a trial lapses

Your data is not deleted, touched, or held hostage. Without paid access you keep:

• สินทรัพย์ลงทุน — the overview of what your holdings are worth. Prices stop updating, so the figures stand as at the day access ended.
• Export to Excel, in Settings, of everything you have entered.

Paying again restores the rest exactly as it was.

Android app — free, and nothing is sold inside it

There is no purchase and no subscription inside the app. It works the moment you install it, with nothing to sign up for; and if you never sign in there is no trial to expire, because there is nothing to expire — the free tier lasts indefinitely.

Whatever you recorded before signing in is not lost. On the first sign-in, the portfolios on the device and the portfolios on the account are merged. Neither side overwrites the other.

5. Refund policy

Website purchases (Stripe)

Payments are not refundable. The 14-day free trial is the opportunity to evaluate SAPH: nothing is withheld during it, so what you are buying is what you have already been using. Access continues for the full year you paid for.

If SAPH fails in a way that stops you using what you paid for, write to saphdevelop@gmail.com from the address on the account, describing what happened. We consider such cases individually.

This does not affect your rights under Thai consumer law.

If we do agree to a refund

• A full refund ends paid access when the refund is requested, not when the money finally arrives. A PromptPay refund can take three to five working days to reach your bank; your account returns to the free plan immediately.
• A partial refund — where we return part of the price rather than all of it, to settle a specific complaint — is not a cancellation, so your access runs to the end of the year as normal. You are not left having paid for a year and lost it over a partial settlement.
• Either way, your data is untouched. Refunding does not delete anything.

Refunds are returned to the original payment method.

The Android app

Nothing is sold in the app, so there is no Google refund to ask for. All payment happens on the website and the sections above govern it.

If you bought through Google Play in the past, we cannot refund it — we never received the money. Request it in Play Store → Menu → Payments & subscriptions → Order history. If Google declines and you believe the fault is ours, write to us and we will help you take it up with them.

6. Intellectual property & fair use

SAPH — its code, design, content, and the logic behind it — is our copyright. Ordinary use of the app does not transfer any of it to you.

Please do not: copy the code or design to build a service of your own; reverse-engineer it for that purpose; resell or redistribute SAPH or its market data as a service of your own; attempt to access another user's data; automate requests at a volume that degrades the service for others; or work around the paid features rather than paying for them.

We may suspend an account that does these things.

7. Availability, changes, and ending the service

SAPH is provided on a best-effort basis. There is no guaranteed uptime: it may be unavailable for maintenance, because a third-party service we depend on is down, or without warning.

Features may change as the app develops. Where a change removes something a paid account was relying on, we will say so in advance rather than let it disappear without warning.

We may end the service. If that happens we will tell you by email before it does, and export will keep working so you can take your data with you.

8. Limits of responsibility

SAPH is provided "as is". To the extent Thai law allows, we are not liable for investment losses, tax consequences, decisions made using figures shown in the app, or data lost where you had no backup. Nothing here limits liability that cannot lawfully be limited, and nothing here affects your rights as a consumer under Thai law.

Where we are liable, our total liability is limited to the amount you paid us in the twelve months before the claim.

9. Changes to these terms

If these terms change, the updated version is published on this page with a new date. Changes that materially affect a paid account will also be sent by email before they take effect.

10. Governing law

These terms are governed by the laws of Thailand, and the Thai courts have jurisdiction. Where the Thai and English texts on this page differ, the Thai text applies.
